Terms of use for S360

PLEASE READ THESE TERMS OF USE (“TERMS”) AND PRIVACY POLICY WHICH IS PUBLISHED ON THE WEBSITE: www.vtc.edu.vn AND www.plus.vtc.edu.vn CAREFULLY BEFORE DOWNLOADING, INSTALLING, AND/OR USING THIS Application FOR THE FIRST TIME.

These Terms constitute an agreement made by and between you and S360 concerning your use of the S360 Application. By downloading, installing, and/or using the S360 Application, you have fully read, understood, and accepted all these Terms and agree to be bound by this agreement.

If you disagree with any part of the Terms (this version or updated ones) then you may not download, install or use the S360 Application, or you may uninstall the Application from your devices.

1. About S360 Application

S360 Applicationlication or S360 Application is software that allows VTC Academy students to manage, contact, and update information between VTC Academy and themselves more easily and quickly.

2. Title and Intellectual Property

This Applicationlication is developed and owned by VTCE Education Development Investment Joint Stock Company (VTC Information Technology and Design Academy – VTC Academy) (“VTC Academy”). VTC Academy was established and operated under Vietnamese law.
Business registration number: 0105889290, registered for the first time on 2012/05/22, issued by Ha Noi Department of Planning and Investment.

VTC Academy solely owns all intellectual property rights (including, but not limited to, code source, pictures, data, the content mentioned in the Applicationlication, any modifications, corrections, modifications, enhancements, and/or updates or upgrades thereto) and guiding documents (if any). Without the prior written agreement or permission of VTC Academy, no individual or organization may copy, reproduce, distribute, publish, display, perform, modify, or otherwise exploit any such content relating to the intellectual property rights of VTC Academy.

3. General Terms

By using this Application, you represent and warrant that you have attained the legal age of majority or obtained consent from your parent or legal guardian to execute this agreement under Vietnam’s law. In case you are found to be incapacitated or do not obtain consent from your parent or legal guardian, we reserve the right to refuse service and block your account.

By using the S360 Application, you confirm that the registration information you provide on our Application is true, accurate, complete, legal, and valid at the moment of registration and that any changes to your registration information should be updated promptly so that we can contact you if necessary. All your rights and obligations shall be based on the registration information you have provided.

By providing information, you represent that you allow us to use and share your information with our Service Providers and trusted third-party partners. We are committed to protecting your privacy rights under the Applicationlicable law.

When you provide your email address, we shall send you an email with a verification link to your account. You need to click the link and sign in to your account with the registered email and password.

If you’d rather change registered information, you can send a detailed request to us. We shall support you, to the best capacity, in updating the registered information as requested within thirty (30) working days since the receipt of the request.

Each user can only use and manage a single account. You must not share registered information with others to sign in to the Application or transfer your account to any third parties. Users have the responsibility to protect the privacy of personal accounts and passwords and any information provided to them. Accordingly, you agree that you shall be solely responsible to us for all activities that occur under your account.

Each account can be signed in on different devices owned by users with the same registered email address.

Any dispute between two or more parties relating to the account owner shall be settled by us as the sole arbiter and all our decisions are final and binding on all parties.

Your commitments

DO NOT damage, modify, adjust, control, or remove the Applicationlication from cyberspace in any way, for any reason. We have no responsibility if you do not have a compatible device or have downloaded the wrong version on your device. We reserve the right to prevent you from using the Application if you use an incompatible or unauthorized device, or use the Application for illegal and unethical purposes, or other purposes that are not intended by the Applicationlication.

DO NOT redesign, compile, make derivative works of, disassemble, or reverse engineer any part of the Application.

DO NOT republish, copy, share, resell, or use any part of or the whole Applicationlication for commercial purposes, or project it to a large group of people, on any media, or in any forms, without our prior written permission.

DO NOT upload, post, or otherwise transmit through the Application any viruses or other harmful, disruptive, or destructive files.

DO NOT upload, post, transmit, or store indiscriminate attacks, advertising content, deceptive links, or information that violates the laws and regulations, customs, discriminatory, ethics, or cause racial division, or offend and harm the legitimate rights of other individuals.

DO NOT use our brand identity nor logo, markings in any form without our written agreement.

DO NOT use offensive or threatening words, or harass or slander others.

DO NOT discuss issues related to religion, political institutions, Party, and Government.

4. Our responsibilities

All arising issues shall be resolved as soon as possible to avoid interruptions in using the Applicationlication.

We accept and attempt to resolve your notices of unauthorized use of your personal information on the Applicationlication.

We are not responsible for any delay, damage, or loss resulting from the Internet or electronic connection including your device that is defective, disconnected, turned off, or inactive.

5. Disclaimer

We make no representations or warranties that the Applicationlication shall be entirely avoided from loss, damage, attack, virus, interception, intrusion, or other security threats, and you agree to release us from any responsibilities and obligations relating to foregoing.
You agree that you shall defend, indemnify and release us, our suppliers, affiliates, employees, directors, officers, attorneys, and agents from all claims, costs, damages, liabilities, and losses (including costs and attorneys’ fees) arising out of or in connection with: (a) your use of the Applicationlication relating to any third-party partners, advertising agencies and/or sponsors, or (b) your breach and infringement of any Terms or any Applicationlicable regulations or laws, which may be invoked herein, or (c) your violation of any rights of the third parties, including the third parties mentioned in the Applicationlication, or (d) the illegal use or abuse of the Applicationlication. Your obligations to defend and indemnify shall remain valid after the termination of Terms or your stop of using the Applicationlication.

6. Fees

VTC Academy is committed not to charge any fees from users for the fundamental services provided by the current Applicationlication.

7. Termination

You may stop using the Applicationlication at any time by deleting your account and permanently removing the Applicationlication from your device. These Terms shall be automatically terminated when you permanently remove the Applicationlication from your device, except for Article 5 of the Terms.

We reserve the right to immediately suspend, limit or terminate your use of the Applicationlication if we can prove that you have illegally infringed or violated any part of the Terms or Applicationlicable laws and regulations.

8. Other regulations

Our neglect or failure to declare a breach of the Terms or to enforce any of the rights under this agreement or Applicationlicable laws shall not be deemed to be a waiver of our rights or other breaches.

These Terms are originally in Vietnamese and may be translated into English or other languages. In any case, the Vietnamese language shall prevail.

If any part of these Terms and Conditions is found to be invalid, illegal, or unenforceable under Applicationlicable laws, that provision or part of it shall be deemed unenforceable, while the remaining parts shall remain valid, legal, and enforceable.

Any dispute arising out of or in relation to this agreement that is not resolved within 45 days (forty-five days) shall be resolved by arbitration at the Vietnam International Arbitration Centre (VIAC) under its Rules of Arbitration and the language of arbitration is Vietnamese.

These Terms may be amended, supplemented, or otherwise modified from time to time. We shall notify you on the Applicationlication and/or via Email of any amendments, supplementation, and/or modifications of the Terms. By using the Applicationlication after receipt of this notice constitutes a legal agreement on such amendments, supplementation, and/or modifications.

The information and data on the Applicationlication are for reference only, all requests and modifications related to data and information shall be decided by VTC Academy.
